Eurussian Position

Eurussia agrees with New Zealand. Since Eurussia and Dromoda are Parties to the case, and still awaiting for Kennyland'a official acceptance or rejection, there is no reason to dismiss the case. Furthermore, there is no law allowing the honourable tribunal to assume anything from a party of a case unless they make their position.
Furthermore, (well based on my RP knowledge way back lol) having Eurasian forces and Ivanian forces deployed to protect Kennyland, which is a Party to the case, translates to the support of Eurasia and Ivania, judges to this case. Thus, cannot remove the notion there is a strong probability of partiality on their part and thus making themselves an direct Parties to this case. Hence, Eurussia calls on Eurasia and Ivania, to inhibit from this case for the sole purpose of impartiality and neutrality for the eventual peaceful resolution of the dispute, as required under the World Alliance Constitution.
On the other hand, Eurussia deplores the inaction of the honourable tribunal for its inaction on the interference of non-participants to this case. Thank you.

OOC: Indeed, this is an RP thing. And it may be left open forever, so be it. As there is no way a case can be dismissed when a Party to it still pursues the case, as prescribed by the Constitution and the Revised Judicial Protocol Act.

Furthermore, I believe this is the second time you have unlocked a thread I specifically ordered locked without the instructions of anyone on the Court or in any other position of power. Consider this your second warning before it is considered abuse of power.

Again, I'm sorry but Eurussia believes that there is no reason to dismiss the case. The prosecuting Party is active, hence, why not the tribunal asks for evidences from the Prosecuting Party?

Because the Defending Party isn't here. When (if) KennyLand comes on, the Court case will have to be reinstated.

I haven't asked for your evidence because receiving it wouldn't do anything. KennyLand still isn't here, thus the case cannot continue. When he is here, the case will be reopened. Until then, it is dismissed.

This case is dismissed.

KennyLand isn't here. Per the Revised Judicial Protocol Act Section I Part 2, "But if any of the party refuses and if the court finds the complaint to possess probable cause containing obvious violations to the WA Constitution or any legally enforced agreement, the case shall proceed regardless of the refusal." As KennyLand has "refused" to come to Court, and the Court has not found any illegal wrongdoings on his part nor Dromoda's part, the case will not proceed. This is a civil lawsuit and the defendant has failed to show any illegal actions on the part of KennyLand.

Thus, the case is dismissed.

Eurussia respectfully disagrees with the honourable court, first of all, it is the responsibility of nations to respond to notices of constitutionally mandated organs of the world. And for that includes this tribunal, and here are the reasons why we disagree with the beliefs of the Court,
1) It is the tribunal itself that admitted that Kennyland has not come to court 'yet' and we are sure that there are notices given to Kennyland. And unless there is an official and formal response of rejection or refusal to the case, we believe that it is the only time there is a refusal of the said Party, which is Kennyland.
2) Notwithstanding the status of Number 1, we have stated from the very beginning of the case that there are clear violations of the WA Constitution, and that is violations on Article 1, where the dispute has caused threats to the world's security, peace and stability that resulted to lots of tensions and military maneuvers with which Eurasian forces and Ivanian forces, whose nations are judges of this tribunal, are involved and direct participants in the escalation of tensions. Thus, there is a strong probable cause to hear the case.
3) Lastly, we have requested Eurasia and Ivania to adhere to the spirit of the Constitution, being a direct party to this case by openly sending forces to Kennyland, to inhibit from the case as required under the Constitution.
