(Dismissed) Xolox Claim to China China's Land

Post  Xolox on Sat Feb 07, 2015 11:03 pm

I request that what was formerly Chinese land be absorbed into Xolox. We have a significant Chinese population (+30) that has fled to our country during times of war and we feel we should allow them to return home without risk of death. our main country, not a colony, is sharing a border with Ohem and is in an optimal position to set up a transitioning communist in their government's absence.  We feel a direct transition from communism to anarchism would be fatal for their people.

Scouting wishes to know what legislature allows for Xolox to annex the Chinese land.

WA Land Bidding Act

The "WA Land Bidding Act" only allows for claims of land If the nation was ejected or banjected. Unless you can provide any other lawful reason, This request will be denied.

China China ejected himself. He removed himself from the region, asked to be removed from the roleplay, and relocated to the rejected realms. What is he missing?

Seeing as China China voluntarily left the region and relocated to "The Rejected Realm" we can understand the reasoning behind your request. Therefore, I will consult with the POTSC.

Eurussia respectfully objects to this interpretation. Having China China 'voluntarily' left the region and went to the 'Rejected Realms' doesn't qualify for the provisions of the WA Land Bidding Act which only allows to open vacated lands for other claims if a nation was ejected out of the region which means 'forcefully kicked out.'

We do not also think China China was even capable of ejecting himself from the World Alliance though.

You did not specify which definition of ejected you were using in the law. One can eject oneself from a region just as they can eject themself from a failing airplane.

Indeed. When used with force such as ejection from an airplane as you have cited. We believe that the general definition of ejection remains being forcefully thrown out.

Forceful ejection from an airplane(or a region) is triggered by the pilot, in our case, the player, or whoever is being ejected. There is no outside force that chooses to eject them when using this definition. They are not "thrown out", so much as escaping by their own choice.

I think this highlights more then anything the vagueness of some of our more important acts. I can't tell you how many times I've looked at a line in a law and ask myself "what does that mean?" only to not get a response that edited said law afterward.

Since there has been no answer, I assume my claim will be processed?

After looking over the conversations, it really doesn't seem like a nation can "eject" itself. Nations that are clearly labeled as "ejected" have that because an admin put it on them. Unless China China somehow had access to admin controls for the region and claimed he ejected himself, this doesn't comply with what the Land Bidding Act states. So we as well feel like this request should be dismissed, but we would like to request that an amendment be added that will deal with when nations voluntarily leave the region and leave territory behind.

Leaving the region does not count a being ejected. It's not a loophole in the bill. By the way nationstates works you are only ejected if the founder or delegate hits the eject button. Any person with common sense can see that.

That's why I had the hard time understanding how can he say that China China ejected himself out of the region :-/
